「养花记-植物养护记录与提醒，浇水管家」 是一款由 燕翔 （以下简称"我们"）提供的产品。「养花记-植物养护记录与提醒，浇水管家」服务以及该服务所包括的各种业务功能统称为"我们的产品和/或服务"。

《养花记用户协议》（以下简称"本协议"）是用户与我们就下载、安装、复制、使用我们的产品和/或服务订立的契约。请在开始使用我们的产品和/或服务之前，认真阅读并充分理解本服务协议。

如同意本协议，即表示已充分阅读、理解并接受本协议的全部内容，并与我们之间达成一致，成为 养花记 用户；如果不同意本协议的任意内容，或者无法准确理解本协议条款的解释，请不要对相关条款内容对应的功能进行任何后续操作，否则，使用及任何操作行为，均视为已接受本协议约束。

使用养花记产品及服务将视为您同意以下使用条款。

仅供个人使用

养花记仅供用户个人用于非商业用途。如果要销售养花记或者与养花记有关或派生的任何资料、服务或软件，则必须得到我们的允许。如果用户对养花记有任何意见，或有如何改进的建议，可向我们提出。

知识产权

用户承认燕翔拥有对养花记的所有权利，包括但不限于所有知识产权。"知识产权"指在专利法、版权法、商业机密法、商标法、反不正当竞争法等法中规定的所有权利以及其中的所有应用、更新、扩展和恢复，无论在现在还是以后在全球范围内实施和生效。用户同意不会修改、改编、翻译 养花记、创作养花记的派生作品、通过反编译、反向工程、反汇编或其它方式从养花记得到源代码。用户同意不会删除、掩盖或更改养花记或任何第三方的版权声明、商标或其它所有权声明。

用户注意事项

软件使用规范

用户应当对其使用本软件及相关服务的行为负责，除非法律允许或者经我们事先书面许可，你使用养花记软件及相关服务不得具有下列行为：

• 使用未经我们授权或许可的任何插件、外挂、系统或第三方工具对养花记 软件及相关服务的正常运行进行干扰、破坏、修改或施加其他影响。
• 利用或针对养花记 软件及相关服务进行任何危害计算机网络安全的行为，包括但不限于：
  • 非法侵入他人网络、干扰他人网络正常功能、窃取网络数据等危害网络安全的活动；
  • 提供专门用于从事侵入网络、干扰网络正常功能及防护措施、窃取网络数据等危害网络安全活动的程序、工具；
  • 明知他人从事危害网络安全的活动的，为其提供技术支持、广告推广、支付结算等帮助；
  • 使用未经许可的数据或进入未经许可的服务器/账号；
  • 未经允许进入公众计算机网络或者他人计算机系统并删除、修改、增加存储信息；
  • 未经许可，企图探查、扫描、测试"便签"系统或网络的弱点或其它实施破坏网络安全的行为；
  • 企图干涉、破坏 养花记系统或网站的正常运行，故意传播恶意程序或病毒以及其他破坏干扰正常网络信息服务的行为；
  • 伪造 TCP/IP 数据包名称或部分名称；
• 对 养花记软件及相关服务进行反向工程、反向汇编、编译或者以其他方式尝试发现本软件的源代码；
• 恶意注册 养花记软件及相关服务的账号，包括但不限于频繁、批量注册账号；
• 违反法律法规、本协议、我们的相关规则及侵犯他人合法权益的其他行为。

如果我们有理由认为你的行为违反或可能违反上述约定的，我们可独立进行判断并处理，且有权在不事先通知的情况下终止向你提供服务，并追究相关法律责任。

内容行为规范

使用养花记必须遵守国家法律法规，用户承诺绝对不会通过我们的产品和 / 或服务发送或传播违反国家法律法规及不文明的信息。否则，我们可对用户发布的信息依法或依本协议进行删除或屏蔽，并有权视情节采取警告、限期改正、暂停服务等措施。此类信息包括但不限于：

• 反对宪法所确定的基本原则的；
• 危害国家安全、泄露国家秘密、颠覆国家政权、破坏国家统一、损害国家荣誉和利益的；
• 煽动民族仇恨、民族歧视，破坏民族团结的；
• 破坏国家宗教政策，宣扬邪教和封建迷信的；
• 散布谣言，扰乱社会秩序，破坏社会稳定的；
• 散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的；
• 恐吓、侮辱、攻击、诽谤他人，侵害他人合法权益的；
• 利用本平台从事洗钱、窃取商业秘密、窃取个人信息等违法犯罪活动的；
• 发布任何侵犯他人著作权、商标权等知识产权及其他合法权利的；
• 侵害未成年人合法权益或者损害未成年人身心健康的；
• 散布商业广告，或类似的商业招揽信息、过度营销信息及垃圾信息；
• 含有其他违反法律法规、政策及公序良俗、干扰便签正常运营或侵犯其他你或第三方合法权益内容的其他信息。

隐私保护

我们重视对你隐私的保护，你的个人隐私信息将根据《养花记隐私政策》受到保护与规范，详情请参阅《养花记隐私政策》。

服务变更

我们保留随时变更、中断或终止服务而不需通知用户的权利。用户接受我们行使变更、中断或终止服务的权利，我们不需对用户或第三方负责。

责任限制

用户理解并同意自主选择下载和使用「养花记」，风险自负，并且对于因下载或使用「养花记」而对计算机系统造成的损坏或数据的丢失，用户应承担全部责任。在适用法律允许的最大范围内，我们明确表示不提供任何其他类型的保证，不论使明示的或默示的，包括但不限于适销性、适用性、可靠性、准确性、完整性、无病毒以及无错误的任何默示保证和责任。

在适用法律允许的最大范围内，我们及其许可人不会向您做出以下声明或担保：

• 您对服务的使用会满足您的需求；
• 您对服务的使用会连续无中断、及时、安全或没有错误；
• 您使用相关服务而获得的任何信息一律准确可靠；
• 作为相关服务的一部分向您提供的任何软件所发生的操作或功能瑕疵将获得修正。

在适用法律允许的最大范围内，我们不就因用户使用「养花记」引起的，或在任何方面与我们的产品和服务有关的任何意外的、非直接的、特殊的、或间接的损害或请求（包括但不限于因人身伤害、因隐私泄漏、因未能履行包括诚信或合理谨慎在内的任何责任、因过失和因任何其他金钱上的损失或其他损失而造成的损害赔偿）承担任何责任。

保障

用户同意保障和我们的利益，负责支付由用户违反本服务条款或我们的其他服务条款而引起的律师费用、损害补偿费用、政府机关处罚费用和其它侵权赔偿费用等。

会员权益

• 当您开通养花记会员之后，您将享受对应的会员权益，具体请查阅应用内会员中心权益说明。
• 根据苹果政策，退款需通过App Store提交申请，我们无法直接处理退款。取消订阅后，您仍可在当前周期结束前继续使用会员服务。
• 因网络故障、系统维护等不可抗力导致服务中断，我们将尽快修复但不提供补偿。
• 会员服务为虚拟数字商品，订阅成功后不支持退订、转让或兑换现金。
• 本条款如有修改，我们将通过应用内公告或您注册的电子邮件通知。继续使用服务视为接受更新后的条款。

自动续费

1. 连续包年会员服务的开通，是基于您已开通养花记会员服务前提下，为您提供的自动会员续费服务。如您开通本服务，则视为您授权我们的产品和/或服务有权在您的养花记会员服务即将到期时，从 Apple 账户（以下统称"账户"）余额中代扣下一个计费周期包年费。 如因前述原因瑕疵（包括但不限于：余额不足、余额不足以满足用户选择多个连续包年服务）而致使无法满足连续包年服务的应用，则我们有权在不再作另行通知的前提下，暂停或终止您的会员服务。如您选择取消连续包年服务，需要在会员到期结束的至少 24 小时前取消订阅，否则系统仍将会自动续订下个月（或下一年）的会员。非因用户违反国家法律法规的规定或本服务条款规定，用户可以选择退订连续包年服务，但是开通时当年的服务费用无法退还。
2. 若选择连续包年服务，您可通过下述方式中止或终止本服务： 前往「App Store」→ 点击右上角顶部您的 Apple ID 头像 → 选择「订阅」→ 取消「养花记会员」。
3. 因养花记会员服务系在线使用的数字化商品，您支付的费用不具有预付款、存款或定金等性质，而是该数字化商品的价格。除法律法规另有规定或养花记另有说明外，会员服务一经开通后不可退款。
4. 我们有权根据用户的需求、产品及服务内容的变化等，对现有会员连续包月的期限、价格及相关内容进行调整，以不断完善、优化服务。如用户对本服务条款内容有任何疑问，可发邮件至（bridget1018@163.com）。

法律及协议更新

根据国家法律法规变化及网站运营需要，我们有权对本协议条款不时地进行修改，并根据国家法律法规的要求进行公示，修改后的协议在公示后生效并代替原来的协议。你应不时关注并阅读最新版的协议及网站公告。如你不同意更新后的新协议，你有权立即停止使用我们的产品和/或服务。如你继续使用我们的产品和/或服务，即视为完全同意更新后的协议。如果本协议中任何一条被司法或行政机关判定废止、无效或因任何理由不可执行，该条应视为可分的且并不影响任何其余条款的有效性和可执行性。

上述条款将受中华人民共和国法律的约束并依据其解释。如出现纠纷，用户和我们一致同意将纠纷交由当地人民法院管辖。如用户对本服务条款内容有任何疑问，可发邮件至(bridget1018@163.com)获取相关信息。

Thank you for using Plant Tracker

"Plant Tracker" is a product provided by YanXiang (hereinafter referred to as "we"). The "Plant Tracker" service and all the business functions included in this service are collectively referred to as "our products and/or services".

The "Plant Tracker User Agreement" (hereinafter referred to as "this Agreement") is a contract between the user and us regarding downloading, installing, copying, and using our products and/or services. Please read this service agreement carefully and fully understand it before starting to use our products and/or services.

If you agree to this Agreement, it means you have fully read, understood, and accepted all contents of this Agreement and reached a consensus with us to become a Plant Tracker user; if you do not agree with any content of this Agreement or cannot accurately understand the interpretation of this Agreement, please do not proceed with any subsequent operations corresponding to the related clause functions, otherwise, the use and any operational behavior will be deemed as acceptance of this Agreement.

Your use of the Plant Tracker products and services will be deemed as your agreement to the following terms of use.

For Personal Use Only

Plant Tracker is for the user's personal non-commercial use only. If you want to sell Plant Tracker or any materials, services, or software related to or derived from Plant Tracker, you must obtain our permission. If you have any opinions or suggestions for improving Plant Tracker, you may submit them to us.

Intellectual Property

The user acknowledges that YanXiang owns all rights to Plant Tracker, including but not limited to all intellectual property rights. "Intellectual Property Rights" refer to all rights specified in patent law, copyright law, trade secret law, trademark law, anti-unfair competition law, etc., as well as all applications, updates, extensions, and restorations thereof, whether currently or in the future, worldwide. The user agrees not to modify, adapt, translate Plant Tracker, create derivative works of Plant Tracker, or obtain source code of Plant Tracker by decompiling, reverse engineering, disassembling, or other means. The user agrees not to delete, conceal, or alter any copyright notices, trademarks, or other proprietary notices of Plant Tracker or any third party.

User Responsibilities

Software Usage Rules

The user shall be responsible for their behavior when using this software and related services. Unless permitted by law or with our prior written consent, you shall not perform the following acts when using the Plant Tracker software and related services:

• Use any unauthorized plugins, add-ons, systems, or third-party tools to interfere with, disrupt, modify, or otherwise affect the normal operation of Plant Tracker software and related services.
• Engage in or target Plant Tracker software and related services with any behavior that harms computer network security, including but not limited to:
  • Illegally intruding into others' networks, interfering with normal network functions, stealing network data, or other activities that endanger network security;
  • Providing programs or tools specifically for intrusion into networks, interfering with network functions and protective measures, or stealing network data;
  • Knowing others are engaging in harmful activities to network security and providing technical support, advertising, payment, or other assistance;
  • Using unauthorized data or accessing unauthorized servers/accounts;
  • Entering public computer networks or others' computer systems without permission to delete, modify, or add stored information;
  • Attempting to probe, scan, test weaknesses of the "Notes" system or network without permission or engaging in other behaviors that damage network security;
  • Attempting to interfere with or disrupt the normal operation of Plant Tracker systems or websites, intentionally spreading malicious programs or viruses, and other behaviors that disrupt normal network information services;
  • Forging TCP/IP packet names or parts of names;
• Reverse engineering, disassembling, decompiling Plant Tracker software and related services or otherwise attempting to discover the software's source code;
• Maliciously registering Plant Tracker software and related services accounts, including but not limited to frequent or bulk registration;
• Violating laws, regulations, this Agreement, our related rules, or infringing others' legal rights.

If we have reason to believe your behavior violates or may violate the above provisions, we may independently judge and handle the matter, and have the right to terminate services to you without prior notice and pursue related legal liabilities.

Content Conduct Rules

Users must comply with national laws and regulations when using Plant Tracker, and promise never to send or disseminate information through our products and/or services that violates national laws, regulations, or is uncivilized. Otherwise, we may delete or block the user’s published information according to laws or this Agreement and may take measures such as warnings, deadlines for correction, or suspension of services depending on the situation. Such information includes but is not limited to:

• Opposing the basic principles established by the constitution;
• Endangering national security, leaking state secrets, subverting state power, undermining national unity, or damaging national honor and interests;
• Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;
• Undermining national religious policies, promoting cults and feudal superstitions;
• Spreading rumors, disturbing social order, or undermining social stability;
• Disseminating obscene, pornographic, gambling, violent, murderous, terroristic, or crime-inciting content;
• Intimidating, insulting, attacking, or defaming others, or infringing others' lawful rights;
• Using this platform for money laundering, stealing trade secrets, or stealing personal information;
• Publishing any content that infringes others' copyrights, trademark rights, or other intellectual property and lawful rights;
• Infringing minors' lawful rights or harming minors' physical and mental health;
• Spreading commercial advertisements or similar business solicitations, excessive marketing, and spam;
• Containing other information violating laws, policies, public order and good customs, disrupting normal operation of Notes, or infringing your or third parties' lawful rights.

Privacy Protection

We value protecting your privacy. Your personal private information will be protected and regulated according to the "Plant Tracker Privacy Policy". Please refer to the "Plant Tracker Privacy Policy" for details.

Service Changes

We reserve the right to change, suspend, or terminate services at any time without notifying users. Users accept our rights to change, suspend, or terminate services and we are not liable to users or third parties.

Liability Limitation

Users understand and agree to bear the risks of downloading and using "Plant Tracker" by themselves, and shall bear full responsibility for any damage to computer systems or data loss caused by downloading or using "Plant Tracker". To the maximum extent permitted by applicable law, we expressly disclaim any other warranties, whether express or implied, including but not limited to implied warranties and liabilities of merchantability, fitness for a particular purpose, reliability, accuracy, completeness, absence of viruses, and error-free operation.

To the maximum extent permitted by applicable law, neither we nor our licensors make the following representations or warranties to you:

• Your use of the service will meet your needs;
• Your use of the service will be uninterrupted, timely, secure, or error-free;
• Any information obtained by you through the service will be accurate and reliable;
• Any software provided as part of the service will have its operational or functional defects corrected.

To the maximum extent permitted by applicable law, we will not be liable for any accidental, indirect, special, or consequential damages or claims arising from your use of "Plant Tracker" or related to our products and services in any way (including but not limited to personal injury, privacy leaks, failure to fulfill any responsibility including good faith or reasonable care, negligence, or any other financial or other losses).

Indemnification

Users agree to indemnify and hold harmless our interests from all legal fees, damages, government penalties, and other infringement compensation fees caused by the user’s violation of these service terms or other rules.

Membership Benefits

• After you activate Plant Tracker membership, you will enjoy the corresponding membership benefits; please refer to the membership center inside the app for details.
• According to Apple policies, refunds must be applied through the App Store; we cannot directly process refunds. After canceling a subscription, you may continue to use the membership service until the current period ends.
• We will repair any service interruptions caused by network failures, system maintenance, or other force majeure as soon as possible but do not provide compensation.
• Membership services are virtual digital goods; after successful purchase, you cannot request refunds or exchanges except as required by applicable laws.
• We reserve the right to adjust membership benefits and fees at any time, with proper notice as required by applicable law.

Children’s Privacy Protection

Plant Tracker does not intentionally collect personal information from children under 13 years old. If we learn we have collected such information, we will promptly delete it. If you are a parent or guardian and believe your child has provided us with personal information, please contact us to request deletion.

Dispute Resolution

This Agreement is governed by the laws of the People's Republic of China without regard to conflict of laws principles. Any disputes arising from this Agreement shall be resolved through friendly negotiation; if negotiation fails, disputes shall be submitted to the court located at our domicile.
